Any Non-Human Visitors to the Website shall be considered agents of the individual(s) who controls, authors or otherwise makes use of them. Ownership of Materials and Restrictions on Use. All material on the Global Pedigree site (including text, images, databases and other information) is owned or licensed by me. You may view, download, and print material from this site only for your personal, noncommercial use unless I specifically indicate that other uses are permitted. You may not use this site or information found at this site or its affiliated sites (including the names and addresses of those who submit information) for selling or promoting products or services, soliciting clients, or any other commercial purpose. The sole exception to this policy is for selling, promoting, and soliciting buyers for animals owned by you and recorded on this site.
Notwithstanding the foregoing, I reserve the right, at my sole discretion, to deny, revoke, or limit use of the Global Pedigree site to any person for any or no reason. I are not responsible for any use that you make of materials from this site, and you agree to fully indemnify me for any claims against me that arise from your actions. In many instances, I do not provide source citations, and in no case do I guarantee that materials on this site are legally available for any use beyond personal, noncommercial use.
Registration Obligations. In consideration for the use of the Global Pedigree site, you represent that you have read and agreed to the terms of this Agreement and that you are legally able to register to use this site. If you submit personal information to this site you agree to (A) provide true, accurate, current, and complete information about yourself (as indicated during the registration process) and (B) maintain and keep current and accurate this information about yourself, should it ever change. If you provide false, inaccurate, inappropriate, or libelous information or images, I may suspend or terminate your account. During the registration process, you will be asked to create a username and password to access certain portions of the Global Pedigree site. You are responsible for maintaining the confidentiality of your username and password. You agree that you are responsible for all activities that occur using this username and password. If someone else uses your username and password in such a way as to breach the terms of this Agreement, you remain responsible for his/her actions, and use of your username may be suspended or terminated.
License to Use. In exchange for your use of the Global Pedigree site and storage of the data you submit, you give me permission to use any data relating to animals and any discussions regarding those animals that you submit and to copy and distribute such throughout the world by any means I deem appropriate, electronic or otherwise, including the Internet, without compensation to you of any kind. You grant to me an unrestricted, royalty-free, worldwide, perpetual license to any copyright, author's right, database right, or similar right that you may hold in your contributed data, and you also grant to me the right to create derivative works by combining your data with that of other contributors.
Special License Restrictions for Non-Human Visitors. Special restrictions on a visitor's license to access the Website apply to Non-Human Visitors. Non-Human Visitors include, but are not limited to, web spiders, bots, indexers, robots, crawlers, harvesters, or any other computer programs designed to access, read, compile or gather content from the Website automatically.
Email addresses on this site are considered proprietary intellectual property. It is recognized that these email addresses are provided for human visitors alone. You acknowledge and agree that each email address the Website contains has a value not less than US $50. You further agree that the compilation, storage, and/or distribution of these addresses substantially diminishes the value of these addresses. Intentional collection, harvesting, gathering, and/or storing this Website's email addresses is recognized as a violation of this agreement and expressly prohibited.
Collaboration with Others. You acknowledge that a primary purpose of this site is to enable collaboration between all users of the Global Pedigree site who wish to expand their knowledge of the ancestral lines of animals they own. You acknowledge that I may utilize data that you submit relating to animals and discussions pertaining to animals for the purpose of collaborating with other individuals and organizations in order to create (a) global common pedigree(s) for the purpose of increasing participation in animal husbandry and preserving the records of such. You acknowledge that collaboration between multiple individuals and organizations allows me to obtain additional data that may be provided freely to all users of this site, thus allowing everyone to extend their own ancestral lines. My Privacy Policy provides more details regarding my use of your data.
This site includes a discussion feature. I reserve the right to reuse the discussion information provided and to publish it to others in an effort to help resolve open issues posed or to help educate others. I request you be selective in the information you include in your online discussions, communicating instead through email or other sources where personal contact or other information is being provided. You acknowledge that any items you submit through the discussion feature will be viewable by anyone able to access the site. The discussion feature is intended to help collaboration efforts, to coordinate the correction of errors and to facilitate additional research with other interested users. The discussion feature may not be used for reasons irrelevant to the purposes of the site; to include information that might harm or embarrass others; or that includes offensive or abusive language or content. Disagreements regarding facts pertaining to individual animals are likely to occur, and such disagreements should be set out in clear terms based on the facts and citing sources where possible without resorting to abrupt, insulting or unkind language or comments. The discussion feature may not be used to provide links to external Web pages with inappropriate content or in order to solicit business or other services. I reserve the right to delete or edit content provided in the discussion feature in my sole and absolute discretion and to deny users access to this feature for any or no reason. Please refer to the Code of Conduct section for an outline of the possible consequences for the improper use of the discussion and similar features.
Right to Submit. Whenever you submit data to this site, you are affirming that you have the legal right to contribute that data to me and to grant me the rights set out in this Agreement. You accept legal responsibility for my using your contributed data based on your affirmation. You are solely responsible for all content that you contribute and post to the Global Pedigree site.
Submitting Animals. Users should not submit animals that they do not own or which are not direct anscestors of animals they own or have owned for which they have verifiable documentation to support the veracity of such submissions.
Code of Conduct. You agree that you will not individually, or as part of any collective effort, submit or post information to this site (either at registration, as data submissions, discussions, or any other feature where content can be provided) that could be deemed harmful or offensive to other users, nor will you impersonate another user in order to hide your identity or implicate another in such actions, nor will you mine, collect or use any information from this site with the intent to harm, discredit or prejudice any person or entity. -- You agree to do nothing that might disrupt the flow of data to and from this site, impact the service or performance of this site, or circumvent any of the controls or usage rules that I have implemented. You understand that the result of harmful or offensive actions may include revocation of your right to use the Global Pedigree site and legal action against you.
Care of Submissions. I intend to use reasonable efforts to preserve the integrity of your data contributions and to avoid errors or omissions in the content of this site. However, you agree that I shall be neither responsible nor liable for errors or omissions in any content you may find on this site, nor for loss, damage, or corruption of data that you submit or post.
Legal Status and Jurisdiction. You understand that this Agreement is governed by the laws of the State of Washington, United States of America, without regard to its principles on conflicts of laws. You agree that any legal action you bring against me shall be brought in either the state or federal courts located in Skagit County, Washington, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. You agree to this regardless of your location or any inconvenience to you.
Severability. If any provision of this Agreement is found to be unlawful, void, or unenforceable in whole or in part, the remaining provisions shall be unaffected, unless I determine that the invalid or unenforceable provision is an essential term of this Agreement, in which case I may at my sole discretion amend this Agreement.
Data Protection. If you are located outside the United States, you consent to the processing in the United States of America of any personal data that you submit. You also agree to comply with all applicable laws regarding the transmission of data to or from the United States of America and the country in which you reside.
Limitations of Liability. I shall not be liable for direct, indirect, punitive, special, consequential or other damages resulting from your use of, or your inability to use, this site, the materials in this site, or any Web site linked to or from this site, including, but not limited to, lost profits, business interruption, and loss of programs or other data on your information handling system. To the extent that the above limits are found not to be enforceable, in no event shall my total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing this site or any linked Web site.
